[al-Baqarah, 2:282]

یٰۤاَیُّہَا الَّذِیۡنَ اٰمَنُوۡۤا اِذَا تَدَایَنۡتُمۡ بِدَیۡنٍ اِلٰۤی اَجَلٍ مُّسَمًّی فَاکۡتُبُوۡہُ ؕ وَ لۡیَکۡتُبۡ بَّیۡنَکُمۡ کَاتِبٌۢ بِالۡعَدۡلِ ۪ وَ لَا یَاۡبَ کَاتِبٌ اَنۡ یَّکۡتُبَ کَمَا عَلَّمَہُ اللّٰہُ فَلۡیَکۡتُبۡ ۚ وَ لۡیُمۡلِلِ الَّذِیۡ عَلَیۡہِ الۡحَقُّ وَ لۡیَتَّقِ اللّٰہَ رَبَّہٗ وَ لَا یَبۡخَسۡ مِنۡہُ شَیۡئًا ؕ فَاِنۡ کَانَ الَّذِیۡ عَلَیۡہِ الۡحَقُّ سَفِیۡہًا اَوۡ ضَعِیۡفًا اَوۡ لَا یَسۡتَطِیۡعُ اَنۡ یُّمِلَّ ہُوَ فَلۡیُمۡلِلۡ وَلِیُّہٗ بِالۡعَدۡلِ ؕ وَ اسۡتَشۡہِدُوۡا شَہِیۡدَیۡنِ مِنۡ رِّجَالِکُمۡ ۚ فَاِنۡ لَّمۡ یَکُوۡنَا رَجُلَیۡنِ فَرَجُلٌ وَّ امۡرَاَتٰنِ مِمَّنۡ تَرۡضَوۡنَ مِنَ الشُّہَدَآءِ اَنۡ تَضِلَّ اِحۡدٰىہُمَا فَتُذَکِّرَ اِحۡدٰىہُمَا الۡاُخۡرٰی ؕ وَ لَا یَاۡبَ الشُّہَدَآءُ اِذَا مَا دُعُوۡا ؕ وَ لَا تَسۡـَٔمُوۡۤا اَنۡ تَکۡتُبُوۡہُ صَغِیۡرًا اَوۡ کَبِیۡرًا اِلٰۤی اَجَلِہٖ ؕ ذٰلِکُمۡ اَقۡسَطُ عِنۡدَ اللّٰہِ وَ اَقۡوَمُ لِلشَّہَادَۃِ وَ اَدۡنٰۤی اَلَّا تَرۡتَابُوۡۤا اِلَّاۤ اَنۡ تَکُوۡنَ تِجَارَۃً حَاضِرَۃً تُدِیۡرُوۡنَہَا بَیۡنَکُمۡ فَلَیۡسَ عَلَیۡکُمۡ جُنَاحٌ اَلَّا تَکۡتُبُوۡہَا ؕ وَ اَشۡہِدُوۡۤا اِذَا تَبَایَعۡتُمۡ ۪ وَ لَا یُضَآرَّ کَاتِبٌ وَّ لَا شَہِیۡدٌ ۬ؕ وَ اِنۡ تَفۡعَلُوۡا فَاِنَّہٗ فُسُوۡقٌۢ بِکُمۡ ؕ وَ اتَّقُوا اللّٰہَ ؕ وَ یُعَلِّمُکُمُ اللّٰہُ ؕ وَ اللّٰہُ بِکُلِّ شَیۡءٍ عَلِیۡمٌ

﴿۲۸۲﴾

O believers! Whenever you strike deals with one another for a fixed period, reduce the transaction to writing. And the scribe amongst you should write it with justice, and should not refuse to write as Allah has taught him to write. So he should write (i.e., meet the requirements of documentation with utmost honesty, in accordance with Islamic law). And he on whom the liability (i.e., debt) falls should dictate the contents of the contract. And he should fear Allah, Who is his Sustainer, and (whilst writing) he should not diminish anything (from the indebted sum). Then if he who has undertaken the liability is mentally deficient or physically weak or lacks the ability to dictate the contents, his guardian should dictate with fairness. And get two witnesses out of your own men. But if two men are not available, then a man and two women: (they) should be from amongst those whom you like as witnesses (i.e., consider trustworthy), so that if either of the two women forgets, the other may remind her. And the witnesses should not refuse whenever they are called (for evidence). And do not be weary of writing it down for its term, whether the transaction is small or large. This documentation by you is more just in the sight of Allah, and makes evidence more solid and nearer to keeping you from doubt, except that if transactions are hand-to-hand which you carry out amongst yourselves, then there is no sin on you if you do not write it down. And take witnesses whenever you bargain amongst yourselves. And let no harm be done to either the scribe or the witness, but if you do so, it will be sheer disobedience on your part. And keep fearing Allah. And Allah grants you knowledge (of the principles of mutual dealing) and Allah knows everything well.

ऐ ईमान वालो! जब तुम किसी मुक़र्ररह मुद्दत तक के लिए आपस में क़र्ज का मुआमला करो तो उसे लिख लिया करो, और तुम्हारे दर्मियान जो लिखने वाला हो उसे चाहिए कि इन्साफ के साथ लिखे और लिखने वाला लिखने से इन्कार न करे जैसा कि उसे अल्लाह ने लिखना सिखाया है पस वोह लिख दे (यानी शरा’ और मुल्की दस्तूर के मुताबिक़ वसीक़ा नवीसी का हक़्क़ पूरी दियानत से अदा करे) और मज़मून वोह शख़्स लिखवाए जिसके ज़िम्मे हक़्क़ (यानी क़र्ज़) हो और उसे चाहिए कि अल्लाह से डरे जो उसका परवरदिगार है और उस (ज़रे क़र्ज़) में से (लिखवाते वक़्त) कुछ भी कमी न करे, फिर अगर वोह शख़्स जिसके ज़िम्मे हक़्क़ वाजिब हुआ है ना समझ या नातवां हो या ख़ुद मज़मून लिखवाने की सलाहिय्यत न रखता हो तो उसके कारिन्दे को चाहिए कि वोह इन्साफ के साथ लिखवा दे, और अपने लोगों में से दो मर्दों को गवाह बना लो, फिर अगर दोनों मर्द मयस्सर न हों तो एक मर्द और दो औरतें हों (ये) उन लोगों में से हों जिन्हें तुम गवाही के लिए पसंद करते हो (यानी क़ाबिले ऐतिमाद समझते हो) ताकि उन दो में से एक औरत भूल जाए तो उस एक को दूसरी याद दिला दे, और गवाहों को जब भी (गवाही के लिए) बुलाया जाए वोह इन्कार न करें, और मुआमला छोटा हो या बड़ा उसे अपनी मीआद तक लिख रखने में उक्ताया न करो, ये तुम्हारा दस्तावेज़ तैयार कर लेना अल्लाह के नज़दीक ज़ियादा क़रीने इन्साफ है और गवाही के लिए मज़बूततर और ये उसके भी क़रीबतर है कि तुम शक में मुब्तला न हो सिवाए इसके कि दस्त-ब-दस्त ऐसी तिजारत हो जिसका लेन देन तुम आपस में करते रहते हो तो तुम पर उसके न लिखने का कोई गुनाह नहीं, और जब भी आपस में ख़रीदो फरोख़्त करो तो गवाह बना लिया करो, और न लिखने वाले को नुक़्सान पहुंचाया जाए और न गवाह को, और अगर तुमने ऐसा किया तो ये तुम्हारी हुक्म शिक्नी होगी, और अल्लाह से डरते रहो, और अल्लाह तुम्हें (मुआमलात की) तालीम देता है और अल्लाह हर चीज़ का ख़ूब जानने वाला है।
